Will(wasiyat) for an heir

Question: A father made a will(wasiyat)  that his daughter and son will have an equal share of the inheritance. Is this valid?

 

 

بسم الله الرحمن الرحيم

 

Answer: The will(wasiyat) is valid but it will only be implemented if the son gives his consent since his share is going to be affected. However, the son's approval or refusal will be considered after the demise of the father.

 

و تصح...و لوارث في الأظهر إن أجاز الباقي الورثة، و لا عبرة بردِّهم و إجازتهم في حياة الموصي، والعبرة في كونه وارثا بيوم الموت. (مغني المحتاج: ٣\٦١٠)

 

This ruling is based on a hadeeth where Nabi صلّى ألله عليه وسلَّم said:

 

(لا وصية لوارث إلاَّ أن تجيز الورثة) رواه البيهقي بإسناد قال الذهبي: صالح

 

Translation: "There is no will(wasiyat) for an heir unless the other heirs give their approval"  Narrated by Al-Baihaqi
